Jury selection in the long-awaited case of a Tracy man accused of speeding into a Lafayette intersection and touching off a chain reaction accident that killed one and injured several others is set to begin Tuesday in Martinez.
Martinez resident Dale Zenor died March 22, 2007 when a BMW M3 driven by David Caspillo, 41, accelerated through the residential neighborhood behind Acalanes High School, through a stop sign and into a stack of cars waiting for the light at Stanley Blvd. and Pleasant Hill Road.
The force of the impact was so great Zenor's Miata was pushed on top of the car in front of him. He died while Caspillo, a businessman with a penchant for racing BMWs, walked to the ambulance with minor injuries. Caspillo has subsequently pleaded not guilty by reason of insanity to felony vehicular manslaughter.
The first phase of the trial process starts tomorrow at 9 a.m. in Department 6 of the Bray Court Building on Ward Street in Martinez.

My sister is a witness in this case. She was to testify in the morning. The court called her this evening and said she will not have to come until next week.
There maybe a settlement in the works?
